Contest Feature Terms of Service:

General:

• By using the Contest Feature within the ChristmasPrism app, users agree to the following terms and conditions outlined herein.

Limitation of Liability:

• Prolific Software Solutions LLC, its affiliates, or sponsors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) user-generated contests; (b) unauthorized access, use, or alteration of contest entries; or (c) any other matter related to the Contest Feature.

No Endorsement or Verification:

• Prolific Software Solutions LLC does not endorse, verify, or assume responsibility for the accuracy, fairness, or legality of any contest, rules, or prizes provided by users.

Prizes, Winner Selection, and Distribution:

• Prolific Software Solutions LLC, its affiliates, or sponsors are not accountable for the delivery, quality, safety, or legality of any prizes presented in user-generated contests. Entrants participate in contests at their own risk and are advised to exercise caution and judgment before entering or accepting any prizes.

• It is solely the contest organizer's responsibility to ensure that prizes are genuine, safe, and delivered in a timely and satisfactory manner to the winners.

Content and Conduct:

• Contest creators bear sole responsibility for their contest content, including rules, descriptions, and related materials. Contests promoting illegal actions, discrimination, or other inappropriate behaviors, as determined solely by Prolific Software Solutions LLC, may be removed without prior notice.

Age Restriction:

• To create a contest, users must be 18 years of age or older. By instituting a contest, users affirm they meet this age criterion.

Disputes:

• Concerning disputes linked to the Contest Feature, both participants and creators should strive for amicable resolution amongst themselves. If issues remain unresolved, parties are encouraged to contact support@christmasprism.com for assistance. However, Prolific Software Solutions LLC, its affiliates, or sponsors are under no obligation to mediate, intervene, or resolve any disputes.

Indemnification:

• Users shall indemnify, defend, and hold harmless Prolific Software Solutions LLC, its sponsors, and its affiliates, officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, judgments, fees, and expenses related to or arising out of their use of the Contest Feature, including but not limited to their creation, participation, or administration of a contest.

Termination:

• Prolific Software Solutions LLC reserves the right, in its sole discretion, to terminate or suspend any contest or user account that is found to be in violation of these terms or any other policies of the app, without prior notice

Amendments:

• These terms of service may be periodically updated. Users are advised to review them regularly to stay informed of any changes. Continued use of the Contest Feature post any updates signifies acceptance of those changes.

No Warranty:

• The Contest Feature is provided "as-is" without any warranties, either expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Prolific Software Solutions LLC, its affiliates, or sponsors do not guarantee uninterrupted, error-free operation of the Contest Feature or that it will meet users' specific requirements.

Jurisdiction & Governing Law:

• Any disputes arising from or relating to the use of the Contest Feature shall be governed by and construed in accordance with the laws of the state in which Prolific Software Solutions LLC is registered, without regard to its conflict of laws rules. By using the Contest Feature, users consent to the jurisdiction of the courts located within that state.

Severability:

• If any provision of these terms is held to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these terms and will not affect the validity and enforceability of any remaining provisions.

No Waiver:

• Failure by Prolific Software Solutions LLC to enforce any provision of these terms shall not be deemed a waiver of future enforcement of that or any other provision.

Third-Party Beneficiaries:

• Sponsors and affiliates are intended third-party beneficiaries of this Contest Feature Terms of Service. They have the right to enforce these terms directly against users on their own behalf.

Disclaimer on Third-Party Contest Platforms:

• If a contest is administered on a third-party platform (e.g., social media sites), users acknowledge that the contest is in no way sponsored, endorsed, administered by, or associated with such third-party platforms. Users release Prolific Software Solutions LLC, its affiliates, or sponsors and said third-party platforms from all claims and liabilities arising from or related to the contest.

Notification:

• Prolific Software Solutions LLC reserves the right to notify the appropriate authorities or take legal action against anyone who violates these terms, at its sole discretion.

Data Privacy and Security:

• Users acknowledge that any personal data they share within the Contest Feature might be stored and processed by Prolific Software Solutions LLC. All data will be treated with respect to privacy regulations and will not be shared with third parties without explicit consent. Users are advised to refrain from sharing sensitive personal information within the contest entries.

Intellectual Property Rights:

• All content and materials related to the Contest Feature, including but not limited to its design, text, graphics, and the selection and arrangement thereof, are the intellectual property of Prolific Software Solutions LLC or its licensors. Unauthorized use of this content without prior written permission is prohibited.

User Representations:

• By using the Contest Feature, users represent and warrant that they own or have the necessary rights and permissions to use and authorize Prolific Software Solutions LLC to use all copyright, trademark, and other proprietary rights in and to any content submitted via the Contest Feature.

Misuse of Feature:

• Any misuse of the Contest Feature, including the creation of fake contests, fraudulent activity, or attempts to manipulate or unfairly influence results, may result in immediate termination of the user's account and potential legal action.

Contest Cancellation:

• Prolific Software Solutions LLC reserves the right to cancel any contest that doesn't adhere to the terms of service or for any other reasons deemed appropriate by the company, without prior notice to the contest creators or participants.

Accessibility:

• Prolific Software Solutions LLC strives to ensure that the Contest Feature is accessible to users with disabilities. However, due to the user-generated nature of the content, the company cannot guarantee that all contests will be fully accessible.

Feedback and Suggestions:

• Users are encouraged to provide feedback on their experience with the Contest Feature. While Prolific Software Solutions LLC is under no obligation to act on such feedback, it appreciates user input to improve its services.
